The Honorable supreme court of India issued court’s contempt notice to the officeholders of the Bar Association of Rajasthan high court Jaipur branch for violating the order of the high court as a part of the strike. The Supreme court bench observed that even after giving repeated notices or judgments of the supreme court which prohibit court boycotts and strikes by lawyers, the Jaipur Bar Association went on a strike on 27th September.
Senior advocate Manan Mishra informed the bench that the bar council of India has issued a notice to Jaipur Bar Association over the violation and that they have replied stating that the boycott was only with respect to one branch of the High Court. The supreme court sternly said that even this violation was related to only one court but it cannot be tolerated at all. It is contempt of Court. It leads to the demoralization of the Judiciary and its orders. The order stated and ordered the secretary of Jaipur bar association to show their reason or to show cause why contempt proceedings may not be initiated against them.
The issue is related to the boycott of the court of Justice Satish Kumar Sharma. The resolution or procedure of boycott started after the judge reportedly refused to give an urgent listing to a petition seeking protection for a lawyer. The association demanded to the court that the roster be changed to remove criminal matters or from the bench of Justice Sharma.
The honorable supreme court issued the show cause notice for contempt to the Bar Association of Jaipur in the case of District Bar Association, Dehradun in which it took Suo moto cognizance of the trend of lawyer strikes. The Bar Council of India said that the bench had sought a meeting with the State Bar Councils and it is on the way to put some rules and guidelines to curtail the strike of lawyers. On a hearing date, the bench said it is going to pass a detailed order to cure this issue. But also, after much considerations the bar association go on a strike on the 28th of February for which the supreme court took Suo moto cognizance.
